Terms and Conditions of Sale (TCS)
PREAMBLE
These Terms and Conditions of Sale (hereinafter “TCS”) are concluded between:

Any natural person wishing to make a purchase via the website:

Hereinafter referred to as “the Client”
ARTICLE 1 – PURPOSE
These TCS define the rights and obligations of the parties within the framework of online sales of products offered by the Seller on the website www.elganaur.com.
Any order implies full and unconditional acceptance of these TCS.
The Seller reserves the right to modify these TCS at any time.
The applicable conditions are those in force on the date of the order.
ARTICLE 2 – PRODUCTS
The products offered are artisanal botanical perfumes.
Descriptions, photographs, and presentations are created with the utmost care. However:
Photographs are not contractual.
Due to the artisanal and natural nature of the compositions, slight variations in color or scent may occur.
These variations do not constitute a defect.
The products comply with applicable Swiss cosmetic regulations.
ARTICLE 3 – PRICES
Prices are indicated in Swiss Francs (CHF).
Unless otherwise stated, prices are exclusive of delivery fees.
Delivery fees are indicated before final order validation.
The Seller reserves the right to modify prices at any time.
The applicable price is the one displayed at the time of the order.
ARTICLE 4 – ORDER
The Client must:
Add desired products to the cart
Verify the information entered
Accept these TCS
Proceed to payment
The order becomes final after payment confirmation.
A confirmation email is sent to the Client.
The Seller reserves the right to refuse any order presenting an abnormal character (excessive quantity, suspicion of fraud, etc.).
Sales are made within the limits of available stock.
ARTICLE 5 – PAYMENT
Payment is due immediately.
Products remain the property of the Seller until full payment is received.
Accepted payment methods include:
Credit card
PayPal
TWINT (if activated)
Any other method indicated on the website
Transactions are secured via an approved payment provider.
No banking data is stored by the Seller.
ARTICLE 6 – DELIVERY
Products are delivered exclusively in Switzerland and Liechtenstein to the address provided by the Client.
Delivery times are indicative.
The Client must check the condition of the parcel upon receipt.
Any anomaly must be reported to the carrier and the Seller within 48 hours.
The Seller cannot be held responsible for:
Delays attributable to the carrier
Incorrect address provided by the Client
In case of an unclaimed parcel or return due to an incorrect address, reshipping costs will be charged to the Client.
Risk transfer occurs upon delivery of the parcel to the Client.
ARTICLE 7 – RETURNS AND REFUNDS
In accordance with Swiss law, no legal right of withdrawal applies to distance sales.
However, the Seller accepts returns only in the following cases:
Defective product
Product not conforming to the order
- If the perfume does not suit the Client
The Client must report the issue within 14 days of receipt at:

Return conditions:
Product unused
Unopened
Original packaging intact
Proof of purchase provided
For hygiene and safety reasons, no opened or unsealed cosmetic product can be returned.
Return costs are borne by the Client, except in cases of Seller error.
After validation:

ARTICLE 8 – LIABILITY
The Seller cannot be held responsible for:
Improper use of the product
Allergic reactions
It is the Client’s responsibility to check for any sensitivities or allergies before use.
In any case, the Seller’s liability cannot exceed the amount of the order.
ARTICLE 9 – INTELLECTUAL PROPERTY
All elements of the Elganaur website:
Texts
Photographs
Visuals
logos
are protected by intellectual property law.
Any reproduction or use without written authorization is prohibited.
ARTICLE 10 – PERSONAL DATA
Personal data is used solely for:
Order processing
Customer relations
Data is not resold.
For more information, the Client may consult the Privacy Policy.
ARTICLE 11 – FORCE MAJEURE
The Seller cannot be held responsible in cases of force majeure, such as:
Natural disasters
Transport interruptions
Major technical failures
Etc.
ARTICLE 12 – APPLICABLE LAW AND JURISDICTION
These TCS are governed by Swiss law.
In case of dispute, the competent jurisdiction is located in the canton of Vaud.
