GENERAL TERMS AND CONDITIONS OF SALE ELGANAUR – BOTANICAL PERFUMERY

Article 1 – Preamble

These General Terms and Conditions of Sale (“GTCS”) govern all sales concluded between Elganaur, publisher of the website www.elganaur.com, and any natural person acting as a consumer wishing to purchase one or more products offered for sale on the website.
The website www.elganaur.com specializes in the creation and sale of botanical perfumes, olfactory compositions, scented objects, and related products inspired by vegetal heritage, artisanal craftsmanship, and alchemical traditions.
Any order placed implies full and unconditional acceptance of these GTCS.
The Customer acknowledges having read and understood these GTCS prior to finalizing their order.

Article 2 – Identification of the Seller

Article 3 – Scope of Application

These GTCS apply to all orders placed on the website www.elganaur.com.
Products are offered to consumers residing in:
all Member States of the European Union: Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, Romania, Slovakia, Slovenia, Sweden
Iceland, Liechtenstein, Norway
Switzerland
and any other country expressly indicated as eligible at checkout.
The Seller reserves the right to modify the list of serviced countries at any time.
These GTCS apply exclusively to sales made to private consumers (B2C). Sales to professionals may be subject to specific conditions.

Article 4 – Acceptance of the GTCS

Any order placed on the website implies acceptance of these GTCS without reservation.
The Customer acknowledges:
having the legal capacity to enter into a contract;
being at least eighteen years old or having authorization from a legal representative;
having reviewed the essential characteristics of the products prior to confirming the order.
The applicable GTCS are those in force at the date of order validation.
The Seller recommends that the Customer keep a copy of these GTCS.

Article 5 – Products

Products offered for sale are presented with the utmost care.
Each product page specifies:
product description;
volume or size;
composition when legally required;
usage instructions;
any precautions for use;
price.
Photographs and illustrations aim to depict the products faithfully. However, slight variations may occur due to:
natural materials used;
variations inherent to botanical ingredients;
screen display settings.
Such differences do not engage the Seller’s liability.
As Elganaur’s creations are crafted from natural raw materials, certain olfactory, chromatic, or aesthetic variations may appear from one batch to another without affecting product quality.

Article 6 – Prices

Product prices are indicated in euros (€) and include all applicable taxes (VAT) when required by law.
For destinations outside the European Union, prices may be displayed excluding taxes. In such cases, customs duties, local taxes, import fees, or administrative charges remain the Customer’s responsibility.
The Seller may modify prices at any time. Products are billed based on the price in effect at the time of order confirmation.
Shipping fees are displayed separately before order validation and depend on destination, parcel weight, and chosen delivery method.
The total price, including products, shipping fees, and applicable taxes, is presented before final confirmation.
In case of a manifest pricing error due to a technical malfunction, the Seller may cancel the order after informing the Customer and refunding any amounts paid.

Article 7 – Orders

The Customer selects desired products and adds them to the cart.
Before finalizing the order, the Customer must verify:
cart contents;
quantities;
delivery address;
billing address;
shipping fees;
payment method.
Order validation constitutes a firm purchase offer.
An order confirmation is sent by email to the address provided.
The Seller may refuse or cancel an order in cases such as:
incorrect or incomplete information;
suspected fraud;
payment failure;
prior dispute with the Customer;
exceptional product unavailability.
In case of cancellation attributable to the Seller, any amounts paid will be refunded promptly.

Article 8 – Payment

Payment is made exclusively through the secure payment solutions offered on the website.
Payments are fully secured by specialized service providers. Elganaur never has access to the Customer’s banking data.
Payment is debited upon order validation according to the payment method used.
If payment authorization is refused or fails, the order is automatically cancelled.
The Seller may suspend shipment until full payment is confirmed.

Article 9 – Delivery

Products are delivered to the address provided by the Customer.
The Customer is solely responsible for the accuracy of the information provided.
Orders are prepared with care and shipped as quickly as possible.
Delivery times indicated on the website are approximate and may vary depending on:
destination country;
peak periods;
customs procedures;
carrier constraints.
The Seller cannot be held liable for delays caused by the carrier or force majeure.
Upon receipt, the Customer is invited to inspect the parcel. Any visible anomaly (damaged, opened, or incomplete parcel) must be reported to the carrier and then to the Seller, with photographs.
Risk transfers when the Customer, or a designated third party, physically takes possession of the products. When the Customer chooses a delivery method that does not require a signature, or authorizes delivery to a specific location (entrance hall, parcel box, locker, building reception, neighbour, etc.), delivery is deemed completed once the parcel is deposited at the location indicated by the carrier. In such cases, the deposit of the parcel constitutes possession, and risks related to loss, theft, or deterioration after deposit are transferred to the Customer.
For deliveries in Switzerland, delivery is deemed completed once the parcel is deposited at the address provided by the Customer, in accordance with Swiss Post practices. Risks related to theft or disappearance after deposit do not engage the Seller’s liability.
If delivery is impossible due to incorrect address, refusal, or prolonged absence, additional shipping fees may be charged for reshipment.

Article 10 – Availability

Products are available while stocks last.
Some creations are produced in limited series or from natural materials, and availability may change rapidly.
If a product becomes unavailable after order validation, the Customer will be informed promptly.
The Customer may choose:
full refund;
an equivalent product when possible;
or to wait for estimated restocking.
No substitute product will be shipped without prior Customer approval.

Article 11 – Right of Withdrawal (EU Customers)

In accordance with EU regulations, the Customer has fourteen (14) calendar days from receipt to exercise the right of withdrawal without justification.
To exercise this right, the Customer may:
use the withdrawal form available on the website;
submit a request via their customer account when available;

An acknowledgment of receipt will be sent.
Products must be returned within fourteen (14) days following the withdrawal request.

Article 12 – Return Conditions

Returned products must be:
complete;
unused;
unopened;
in original packaging;
with all accessories.
The Customer is liable for any depreciation resulting from handling beyond what is necessary to inspect the product.
Return shipping costs are borne by the Customer unless otherwise required by law or in case of Seller error.
Return risks remain with the Customer until the Seller receives the products.
Discovery sets (“coffrets découverte”) cannot be returned or refunded.

Article 13 – Exceptions to Withdrawal

Under EU law, withdrawal does not apply to:
customized or personalized products;
products likely to deteriorate quickly;
sealed products that cannot be returned for hygiene reasons once opened.
The right of withdrawal does not apply to Customers residing in Switzerland.
Perfumes, cosmetics, oils, or any product opened or used cannot be returned unless defective.

Article 14 – Refunds

After receiving and inspecting returned products, refunds are issued using the original payment method unless otherwise agreed.
Refunds occur within fourteen (14) days of receipt or proof of shipment.
The Seller may delay refund until products are recovered.
Initial shipping fees are refunded according to applicable law.
Return shipping fees remain the Customer’s responsibility unless otherwise required or in case of Seller error.

Article 15 – Legal Guarantee of Conformity

The Seller must deliver a product conforming to the contract.
The Customer benefits from legal guarantees applicable in their country of residence when mandatory.
If a product is non‑conforming, the Customer may request:
repair when possible;
replacement;
price reduction;
or refund, depending on applicable law.
These guarantees apply independently of any commercial warranty.

Article 16 – Damaged Products

If a product arrives broken, damaged, or incomplete, the Customer must contact customer service within forty‑eight (48) hours of receipt.
The request must include:
photos of the parcel;
photos of the product;
a description of the damage.
After review, Elganaur may offer:
replacement;
refund;
or another appropriate solution.

Article 17 – Complaints

The Seller will respond as quickly as possible and seek an amicable solution.
Customer satisfaction is a priority for Elganaur.

Article 18 – Liability

The Seller strives to ensure accuracy of information and product quality.
However, liability cannot be engaged in cases of:
misuse of products;
failure to follow instructions;
allergic reactions due to individual sensitivities;
improper use;
force majeure or unforeseeable third‑party actions.
Elganaur guarantees that all olfactory creations are developed in accordance with IFRA standards and Regulation (EC) No 1223/2009 on cosmetic products. Customers are invited to review product composition and perform a patch test when recommended.
Images and descriptions are illustrative and may differ slightly from delivered products.
Liability is limited to the amount paid for the order unless otherwise required by law.

Article 19 – Intellectual Property

All elements on www.elganaur.com, including:
texts;
illustrations;
photographs;
graphic designs;
logos;
trademarks;
visual compositions;
videos;
protected olfactory creations;
and website architecture,
are the exclusive property of Elganaur or their respective owners.
Any reproduction, distribution, adaptation, or exploitation without prior written consent is strictly prohibited.
Unauthorized use may lead to legal action.

Article 20 – Personal Data Protection

Personal data collected during orders is processed exclusively for:
order management;
delivery;
after‑sales service;
customer relations;
legal obligations.
Processing complies with the GDPR and applicable national regulations.
Customers have rights including:
access;
rectification;
deletion;
objection;
restriction;
portability.

Article 21 – Force Majeure

The Seller is not liable for delays or failures caused by events beyond reasonable control, including:
natural disasters;
fires;
pandemics;
armed conflicts;
strikes;
transport network failures;
telecommunications outages;
administrative decisions.
Obligations are suspended during force majeure events.

Article 22 – Applicable Law

These GTCS are governed by the law applicable at the Seller’s registered office.
However, mandatory consumer protection laws in the Customer’s country of residence prevail when offering higher protection.

Article 23 – Dispute Resolution

If a complaint cannot be resolved, the Customer may use a consumer mediation service when applicable.
EU Customers may also use the European Online Dispute Resolution platform.

Article 24 – Partial Invalidity

If any provision is declared invalid, illegal, or unenforceable, the remaining provisions remain fully effective.

Article 25 – Amendments to the GTCS

The Seller may amend these GTCS at any time to reflect:
legislative changes;
regulatory changes;
technical updates;
commercial developments.
The applicable GTCS are those in effect at the time of order validation.

Article 26 – Entry into Force

These GTCS enter into force upon publication on www.elganaur.com and remain applicable until replaced.
